The legal situation in Canada

Hyperliquid's Terms of Use restrict Ontario but not the rest of Canada. Canadian securities regulators require crypto trading platforms serving Canadians to register or sign pre-registration undertakings, and since Dec 2022/Feb 2023 the CSA has barred registered platforms from offering margin or leverage to Canadian clients. The OSC has taken enforcement action against unregistered offshore platforms (e.g. KuCoin, Bybit, Phemex, XT.com); no regulator action naming Hyperliquid was found.

Key facts

  • Hyperliquid's terms list Ontario as a restricted territory; other provinces are not named.
  • The CSA (Dec 2022) said crypto trading platforms may not offer margin or leverage to Canadian users, and set deadlines for pre-registration undertakings including for foreign platforms accessible to Canadians.
  • The OSC/Capital Markets Tribunal has issued orders and penalties against unregistered offshore crypto platforms such as KuCoin, Bybit, Phemex and XT.com.
  • No public Canadian regulator action specifically naming Hyperliquid was found.
  • Tax: the CRA treats crypto gains as either capital gains or business income depending on the activity.

What are your options in Canada?

If Hyperliquid or local law restricts this country, the honest answer is: don't try to get around it. Using a VPN breaks Hyperliquid's Terms of Use and may break local law. Look for derivatives platforms licensed by Canadian Securities Administrators (CSA); Ontario Securities Commission (OSC), and check back here: rules change.
