Is Hyperliquid legal where you live?
Hyperliquid's terms bar users in the United States (including US citizens abroad), Ontario, Cuba, Iran, North Korea, Syria, occupied regions of Ukraine and other sanctioned territories. Elsewhere it is not licensed by national regulators, so it operates in a legal grey area. Check your own country's rules.
Quick facts
- Where is Hyperliquid restricted?
- Its terms restrict the United States, Ontario (Canada), Cuba, Iran, North Korea, Syria, occupied regions of Ukraine and other sanctioned territories.
- Have regulators warned about Hyperliquid?
- Yes: 2 national regulator warning(s) name it, including the UK FCA (May 2026) and Singapore's MAS (June 2026). See the regulatory tracker.
Who is restricted
According to the Hyperliquid Terms of Use (updated 15 June 2026) and the front end's geoblocking, the following are restricted:
| Region | Status |
|---|---|
| United States, including US citizens living abroad | Restricted |
| Ontario, Canada | Restricted |
| Cuba, Iran, North Korea, Syria | Restricted (sanctions) |
| Crimea, Donetsk and Luhansk regions | Restricted (sanctions) |
| Other sanctioned countries, territories and persons | Restricted |
The terms also prohibit using a VPN or similar tools to get around these restrictions. We do not recommend doing so: breaking the terms can lead to loss of access, and in some countries it may also break local law.
Protocol vs front end
The Hyperliquid blockchain itself is permissionless: anyone with a wallet can technically send transactions to it. The website at app.hyperliquid.xyz, run by the people behind the project, is what applies the geoblock and the terms. Being technically able to reach the protocol does not make it legal for you to use; that depends on the law where you live.
The United States
Hyperliquid is not registered with the CFTC or SEC and blocks US persons. On 19 August 2026 President Trump said the CFTC chair was working to bring Hyperliquid to the US legally, but there was no filing or timeline as of October 2026. Until something formal happens, the restriction stands. See Hyperliquid in the US and United States.
Everywhere else
Outside the restricted list, Hyperliquid is not licensed by national financial regulators in most countries. That does not automatically make use illegal, but it means:
- You have none of the protections of a regulated broker: no compensation scheme, no complaints ombudsman, no guaranteed segregation of funds.
- Some regulators restrict or warn against leveraged crypto derivatives for retail investors, and rules on perpetual futures differ widely.
- Trading stock-linked HIP-3 perps can raise extra securities-law questions.
- You are still responsible for tax on your gains, so keep your own records.
No national regulator had taken formal enforcement action (a fine or charge) against Hyperliquid as of October 2026, but two have issued warnings by name: the UK's Financial Conduct Authority added Hyperliquid to its warning list in May 2026, and the Monetary Authority of Singapore added it to its Investor Alert List in June 2026. In the UK, selling crypto derivatives to retail consumers has been banned since January 2021. In the EU, ESMA said in February 2026 that crypto perpetual futures are likely CFDs, which limits retail leverage at regulated EU firms to 2:1. These positions can change quickly.

- Keep records of deposits, trades, funding and withdrawals for tax.
- Never use a VPN or someone else's account to get around restrictions.
Frequently asked questions
Can Americans use Hyperliquid?
No. The terms restrict US persons, including US citizens living abroad. A statement by President Trump in August 2026 about bringing Hyperliquid to the US has not led to any formal change as of October 2026.
Is Hyperliquid legal in the UK and EU?
Neither is on Hyperliquid's restricted list, but Hyperliquid is not licensed in either. The UK's FCA added Hyperliquid to its warning list in May 2026 and bans selling crypto derivatives to retail consumers. In the EU, regulators treat crypto perps as likely CFDs with tight retail leverage limits at licensed firms. Check our country pages.
Can I use a VPN to access Hyperliquid?
The terms prohibit using a VPN to get around restrictions, and doing so can cost you access to your funds. We do not recommend it.
