The legal situation in Germany
Germany is not on Hyperliquid's restricted list and the frontend is not geoblocked. As an EU member state it applies MiCA (licensing for crypto-asset service providers; transitional periods ended by 1 July 2026) and the ESMA-coordinated national CFD measures, which ESMA said on 24 Feb 2026 likely cover crypto perpetual futures. One Trading (AFM-licensed OTF) has offered BTC and ETH perpetual futures to eligible customers in Germany since May 2025; no BaFin action naming Hyperliquid was found.
Key facts
- ESMA's 24 Feb 2026 public statement says crypto 'perpetual futures' are likely CFDs, so national CFD product-intervention measures apply: for retail clients of EU firms, leverage on crypto underlyings is capped at 2:1, with margin close-out and negative-balance protection.
- MiCA transitional periods ended EU-wide by 1 July 2026; crypto-asset service providers without MiCA authorisation must stop serving clients in the EU.
- BaFin implemented the CFD restrictions through a general administrative act (Allgemeinverfügung) in 2019 mirroring ESMA's measures.
- Regulated alternative: One Trading, licensed as an OTF by the Dutch AFM, expanded perpetual futures (BTC/EUR, ETH/EUR, up to 10x for eligible customers) to Germany, the Netherlands and Austria in May 2025.
- Tax: gains on privately held crypto are tax-free after a one-year holding period under §23 EStG; derivatives may be treated differently.
