The legal situation in India
India is not on Hyperliquid's restricted list. Crypto is taxed but not comprehensively regulated, and since 2023 offshore VASPs serving Indians must register with FIU-IND under the PMLA. FIU-IND has had unregistered offshore exchanges blocked: nine in December 2023 (including Binance and Kraken, before Binance registered) and 25 more in October 2025. We found no FIU-IND or government action naming Hyperliquid.
Key facts
- Dec 2023: FIU-IND sent compliance notices to nine offshore exchanges, including Binance and Kraken, and asked MeitY to block their URLs.
- Oct 2025: access was blocked to 25 unregistered offshore exchanges, among them BitMEX, BingX, Phemex, LBank, CoinEx and PrimeXBT.
- Binance, Coinbase, Mudrex, CoinSwitch and ZebPay are FIU-registered; India has no specific regulatory framework for crypto derivatives.
- Tax: Budget 2026 (1 Feb 2026) kept the 30% flat tax on virtual digital asset income and 1% TDS per transfer; losses cannot be set off against other income.
- No block or warning specifically naming Hyperliquid or DEX perps was found.
What are your options in India?
If Hyperliquid or local law restricts this country, the honest answer is: don't try to get around it. Using a VPN breaks Hyperliquid's Terms of Use and may break local law. Look for derivatives platforms licensed by Financial Intelligence Unit-India (FIU-IND); no dedicated crypto regulator, and check back here: rules change.
