The legal situation in Switzerland
Switzerland is not on Hyperliquid's restricted list and the frontend is not geoblocked. Switzerland is outside the EU, so MiCA and ESMA's CFD measures do not apply; crypto services are regulated under Swiss financial-market law. On 22 Oct 2025 the Federal Council opened a consultation (closed 6 Feb 2026) on amending the Financial Institutions Act to create FINMA-supervised 'crypto-institution' and payment-instrument licences, expected to apply from late 2026 or early 2027.
Key facts
- MiCA and the EU's ESMA-coordinated CFD leverage caps do not apply in Switzerland.
- Proposed FinIA amendments would create a FINMA-licensed 'crypto-institution' category for custody and trading of crypto assets; consultation ran 22 Oct 2025 to 6 Feb 2026.
- No FINMA warning or action specifically naming Hyperliquid was found in this research.
- Tax: for private investors, capital gains on crypto are generally tax-free, but holdings are subject to cantonal wealth tax; professional-trader status can make gains taxable income.
