The legal situation in the United States

Hyperliquid's Terms of Use (updated 15 Jun 2026) list the United States as a restricted jurisdiction, including US persons abroad, and the app.hyperliquid.xyz frontend geoblocks US users. Under US law, leveraged crypto derivatives offered to retail must go through CFTC-registered venues; in May 2026 the CFTC allowed KalshiEX and Coinbase to list crypto perpetual futures. In August 2026 Bloomberg reported Hyperliquid Labs was in talks with Kraken parent Payward to offer Hyperliquid-linked perps to US users via its CFTC-registered subsidiary Bitnomial, pending CFTC approval.

Key facts

  • Hyperliquid's terms restrict US residents and US citizens wherever located; the official frontend blocks US IP addresses.
  • Retail leveraged crypto derivatives in the US must be offered on CFTC-registered exchanges (DCMs); in May 2026 the CFTC let KalshiEX and Coinbase list crypto perpetual futures.
  • Mid-August 2026 President Trump said CFTC Chair Michael Selig was working to bring Hyperliquid to the US 'in a fully compliant and legal fashion'; no approval had been reported as of the Aug 31, 2026 Payward/Bitnomial report.
  • On 24 Aug 2026 the Hyperliquid Policy Center urged the SEC and CFTC to harmonise treatment of perpetual contracts.
  • Tax: the IRS treats digital assets as property; gains and losses from crypto trading are reportable for federal income tax.

What are your options in the United States?

See our page on Hyperliquid and US users for the current situation. If Hyperliquid or local law restricts this country, the honest answer is: don't try to get around it. Using a VPN breaks Hyperliquid's Terms of Use and may break local law.
